711.03(d) Examiner’s Statement on Petition To Set Aside Examiner’s Holding [R-08.2012]
37 CFR 1.181 states that the examiner “may be directed by the Director to furnish a written statement, within a specific time, setting forth the reasons for his or her decision upon the matters averred in the petition, supplying a copy to the petitioner.” Unless requested, however, such a statement should not be prepared. See MPEP § 1002.01.
